Furniture4u is owned and operated by Furniture 4 u Specialists Ltd (‘Furniture4u’, ‘we’, ‘us’ or ‘our’). Our postal address is Furniture4u, Belfry House, Bell Lane, Hertford, Hertfordshire, SG14 1BP.
These terms relate to orders made in any of our shopping centres, online or by phone.
The contract made by you with us incorporates these terms and conditions, which shall prevail over any and all terms and conditions proposed by you.
You should not proceed with your order until you have read and agreed to these terms and conditions.
1.1 Our suppliers are continuously developing products and reserve the right to amend the specifications of any goods or products without prior notice in relation to future sales.
1.2 If buying the same products at different times we cannot guarantee they will match due to variations between batches. This includes exact colour match and exact measurements.
1.3 Every effort is made to display as accurately as possible the colours of our products that appear in our showrooms, on our website and in other promotional materials. We cannot guarantee however the complete accuracy of the pictures or photographs that are shown. Many conditions such as your monitor or screen settings and batching can affect the colouring of items in a picture.
2.1 We always try to be as accurate as possible, however measurements specified by us are always approximate. All our products are handmade and so there may be a slight difference on some products (maximum 5cm).
3.1 All prices include VAT, where appropriate, at the prevailing rate and are subject to any promotional offer or discount.
3.2 The prices displayed on the website are for online purchases and promotions only and are not transferable to sales through any other means.
3.3 We will not be bound to honour any prices, where we have indicated to you subsequently that the prices displayed have been displayed in error. In these cases a full refund will be offered.
4.1 You can pay by cash, finance, PayPal, bank transfer or debit/credit card at the time of order.
4.2 In some cases we can accept cash on delivery however we usually need to send your order with a third party courier who do not accept cash on delivery, in this case your balance will have to be paid prior to sending them your order.
4.3 All balances must be paid prior to delivery. Our delivery team will not bring any products into your home until payment has been made.
4.4 The price of any product is the price in place at the date and time of your order. The price may increase or decrease at a later date; this will not affect your order.
4.5 A minimum £50 deposit will be required on all orders. The remaining balance must be paid before the day of delivery.
4.6 We are entitled to refuse any order placed by you and we reserve the right to cancel and refund any order, at any time.
4.7 We offer a monthly payment plan for 12 months (APR 19.9%), this is subject to a credit check, to apply please apply on our website or call us. We will not refund any customers that fail the finance application.
5.1 We are only able to deliver orders to you if you have a delivery address on the UK mainland. This excludes some remote areas; please check our delivery page before ordering.
5.2 At the time the order is placed the order details will be passed to our logistics team who endeavour to schedule a delivery date within 14 days and will call to confirm the date. This date can be postponed or altered if not convenient, and will be dependent upon stock availability, delivery schedules, seasonal constraints, etc. However, we will do our best to ensure that any items you order will be delivered to you within a reasonable time. We will advise you as soon as possible if circumstances beyond our reasonable control affect the estimated delivery time.
5.3 We will remove all packaging from the goods and allow you to examine them to ensure that there are no defects. This includes scratches, tears, rips or scuffs. We will assemble the goods in a room of your choice. It is the customer’s responsibility to inspect the goods immediately upon delivery and ensure that the goods are delivered in perfect condition. No claim for damage at all can be entertained once the delivery team have left the delivery address unless it is signed for as damaged delivery.
5.4 We cannot accept any liability for any damage caused to customers property during a delivery, it is the customer responsibility to ensure there is clear access for the delivery team to enter, If our delivery team considers that access is unsafe, then we will not deliver the goods.
5.5 In the event that you may choose to have your goods delivered to your own third-party carrier, we will not accept any responsibility or liability for any damage to your goods once they are out of our control. Any forwarding delivery is at your own risk.
5.6 We will only deliver to ground floor, to first floor where access is easy, or to higher floors where there is an adequate lift. If delivery is required to higher floors and there is no lift or the lift is not big enough to take the suite, we will deliver to ground floor only and ask that you get help in taking the products upstairs. If you are not satisfied with the solution you can cancel your order and you will lose your deposit or £100 cancellation charge whichever is lower.
5.7 We cannot accept liability if your sofa does not fit into your house, it is the responsibility of the customer to measure the doors, hallways and rooms to ensure the sofa fits. If the worst happens and it really won’t fit in, we will do our utmost to find a suitable solution. If you are not satisfied with the solution you can cancel your order and you will lose your deposit or £100 cancellation charge whichever is lower.
5.8 If the goods are found to be either damaged or defective in any way at the time of delivery we will organise for a replacement or repair immediately depending on the situation. We cannot leave any products in the customer’s possession without full payment.
5.9 Should you not be available at the time of attempted delivery there will be a redelivery charge equal to your original delivery charge. These also apply if we are unable to deliver the goods due to there being no safe means of access to the place of delivery.
6.1 ONLINE OR OVER THE PHONE: Goods must be in their original packaging. You must contact us within 14 days from delivery with your intention to return the item. Under the Consumer Contracts Regulations you have the right to return your product. It is your responsibility to return the goods to us within 14 days of informing us of your decision to cancel. We can arrange a collection for you for a collection fee of £75. Please do not return items without prior authorisation. Goods sent back without prior returns authorisation will be returned back to you and the cost of delivery charged to your account.
6.2 IN STORE: Furniture4u do not accept any returns on products bought in store or in a shopping centre. Once the delivery team have left the property and the customer has confirmed they are happy with the product, the customer cannot return the product.
6.3 All payments to us are non-refundable, this includes all deposits, we do not give any refunds when a customer cancels their order.
6.3 Return of items subject to Interest Free Credit. The purchase of any items on credit terms is made concurrently with a finance agreement between you and the finance company. In the event that you seek to return items that have been purchased under a finance agreement, we will return to the finance company any and all sums advanced by the finance company in relation to their agreement with you, upon the following:
(i) Payment by you, in advance of cancellation fees, return fees and redelivery fees in line with Regulation 14(5) of the Consumer Protection (Distance Selling) Regulations 2000.
(ii) Collection of the items.
6.4 After the 14-day period when purchased online or by phone, has expired we do not accept returns of any items purchased.
6.5 Unfortunately we do not accept any returns for ‘custom made’ goods. Under the Consumer Contracts Regulations 2013 you do not have the right to cancel if your item is personalised or custom made.
6.6 We will not be liable for any damage or loss resulting from repairs attempted by you or third parties.
7.1 All our products come with a 1-year manufacturer’s guarantee, unless otherwise stated. The guarantee starts from the date of delivery and offers cover against manufacturing defects on the structure of the frame and frame springs or any defects which may arise, under normal use, through faulty factory workmanship, including sofa bed and recliner mechanisms. No claims for faulty items will be entertained after the twelve months.
7.2 Under the Consumer rights act 2015, if you discover a manufacturing fault within the first six months, we will repair the item. If the item is un-repairable we will organise a replacement.
7.3 Furniture4u reserves the right to carry out an inspection of the goods in the confinements of your own home using an independent 3rd party company to assertion where the fault is situated.
7.4 Under the Consumer Rights Act 2015 if you discover a manufacturing fault after the first six months, it is your responsibility to prove to us that the item is faulty. If you can provide evidence that the item is faulty, we will repair the item. If the item is un-repairable we will organise a replacement.
8.1 Every effort is made to ensure the complete accuracy of our website, however some prices/details contained on the website may change from time to time and it is possible that errors will occur. We will use our best endeavours to rectify any errors, as swiftly as possible but we cannot be responsible for any losses incurred.
8.3 Our website is owned and operated by Furniture 4 U Specialist (‘Furniture4u,’ ‘we’ or ‘us’ ‘our’), whose registered number is 08056877.
8.4 Any material downloaded or otherwise obtained through the use of our website is done at your own discretion and risk and on the understanding that you will be solely responsible for any damage to your own computer system or loss of data that results from the download of any such material.
9.1 By using this website, you will be deemed to consent to our use of any personal data we collect from you, including your name, address and telephone number, for the purposes of negotiating, entering into and administering a contract and maintaining your account.
10.1 We control and operate our website and showrooms from our offices within England. Accordingly the laws of England and Wales govern claims relating to them, including the use of our website and the materials contained therein. If you choose to access our website from outside England and Wales you do so on your own initiative and you hereby agree that in the event of a dispute between us and you that the laws of England and Wales apply at all times.
